Settlement Reached in 'Shoeless' Ladder Accident

FOND DU LAC, WI – Attorney Jonathan Groth, of Pitman, Kyle & Sicula, S.C., won a $105,000 settlement on behalf of a Fond du Lac man who fell from a ladder that had it’s “feet” cut off.

The 60-year-old victim went to a property to remove the soffit and fascia of a garage. He climbed a previously erected ladder that had no “shoes” or “spur plates.” The victim, unaware that the ladder was altered, climbed up the ladder and continued to work on the garage. As construction progressed, a board fell and hit the ladder knocking it out from under him causing the plaintiff to fall onto a concrete slab. The fall left the victim with two broken elbows.

An investigation suggested that the portion of the ladder that would have had the “shoes” and “spur plates” were most likely cut off. The “shoes” and “spur plates” have a slip resistant tread on them to prevent the ladder from slipping out from underneath the user.

The lawsuit, filed in the Fon Du Lac County Circuit Court, alleges that the defendant failed to provide a safe place, use safety devices and failed to protect the safety and health of the plaintiff.
