| Non-licensed Motorcyclist Injures Other Rider |

JANESVILLE, WI – Attorney Jonathan Groth won a $29,000 personal injury settlement on behalf of a Janesville teenager who was involved in a motorcycle accident. The plaintiff, a 17-year-old male, was traveling northbound on his 2000 Yamaha 600cc motorcycle near Hackbarth Road on County Highway E in Rock County when he lost his eye protection. The plaintiff was about to turn left into a driveway in order to turn around to retrieve his eye wear when another rider driving a 2003 Honda 600cc motorcycle failed to see the plaintiff. Traveling at speeds too fast for conditions, the defendant decided to pass the plaintiff on the left-hand side rather than slow down. In doing so, the defendant ran into the plaintiff as he made his left-hand turn. The plaintiff suffered neck injuries as a result of the accident. The lawsuit, filed in the Rock County Circuit Court, alleged that the defendant was traveling too fast for conditions, failed to properly maintain control of his vehicle and operated a motorcycle without a license. Throughout the presuit and litigation, the defendants claimed they were not at-fault, blaming the Plaintiff. American Family, the insurance company for the Defendant, and the defendant would not take responsibility until the jury found them 100% at fault.
