Driver with Blocked View Enters Traffic, Collides with Semi

MARSHFIELD, WI – Attorney Rich Kalkhoff, of Pitman, Kyle & Sicula S.C., won a $190,000 settlement on behalf of a Marshfield woman involved in an auto accident in Marshfield, WI.

On February 15, 2001, the Plaintiff was riding as a passenger in her own car while the Defendant drove her Ford Mustang southbound on Highway A just outside of town. The Plaintiff and Defendant, along with two other friends in the rear seat, were headed to the defendant’s house in Arpin to retrieve some of his personal belongings.

While traveling down Highway A, the defendant stopped the car at the Highway 10 intersection. Immediately before the defendant pulled out to cross Highway 10, his view to the left (east) was blocked by a semi turning right in a designated right-turn lane. Despite the Defendant’s blocked view, he pulled out to cross Hwy. 10 and was struck by another westbound semi-truck driven by the co-plaintiff.

The collision caused the car to spin off the road and into a ditch where the car’s engine started on fire. The Plaintiff was extracted from the car and taken to St. Joseph’s where she was treated for fractures to both of her legs.

The lawsuit, filed in Wood County, alleged that the driver was driving inattentively, failed to yield the right of way and failed to exercise proper lookout.
