Absent Safety Railing Allows Elderly Woman to Suffer Fatal Injuries

STEVENS POINT, WI – Attorney Richard Kalkhoff, of Pitman, Kyle & Sicula S.C., won a settlement on behalf of a Stevens Point woman who died at a long term care facility after her wheelchair fell off a handicapped accessible ramp.

The Plaintiff exited the main doorway of the River Pines Center in her wheelchair and proceeded down the facility’s handicapped accessible ramp when her wheelchair fell off the ramp causing her to suffer fatal injuries. Attorney Kalkhoff argued that a protective railing had been in place prior to the resident’s fall, but had been removed and not replaced nor repaired prior to the Plaintiff’s accident. It is believed that the railing had been damaged when it was struck by a snowplow the previous winter.

The lawsuit, filed in Circuit Court of Portage County, alleged that the facility failed to furnish a place for employees, frequenters, and/or invitees which was safe and failed to furnish and use safety devices and safeguards to render the property safe. The terms of the settlement were undisclosed.
