PKS Wins Settlement Against VA Hospital
Doctors Fail to Diagnose Patient Five Times

MENOMONEE FALLS, WI - Attorney Jonathan Groth, of Pitman, Kyle & Sicula, S.C., won a $95,000 settlement after a man was misdiagnosed during several visits to the Clement Zablocki VA Medical Center in Milwaukee, WI.

In December of 2004, the plaintiff, a 43-year-old male, complained of pains in his upper abdomen to a VA Hospital doctor. The doctor diagnosed him with constipation and told him to take hot showers to relieve the pain. The plaintiff returned to the hospital's emergency room in January with the same symptoms. This time doctor's took x-rays of his abdomen, but he was given the same diagnosis - constipation.

Three subsequent trips to the VA hospital all resulted in the same diagnosis - constipation. Later that March, the plaintiff had difficulty breathing so his 12-year-old son dialed 911. After arriving at Waukesha's Community Memorial hospital, doctors found that the plaintiff's gall bladder had ruptured. He was immediately admitted and had his gall bladder removed. He remained hospitalized for an infection.

The settlement was reached prior to a lawsuit being filed.
